The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "Your" refers to you, the person log on this website and compliant to the Company’s terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Netherlands. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Unless otherwise stated, Scalexcel and/or its licensors own the intellectual property rights for all material on Scalexcel. All intellectual property rights are reserved. You may access this from Scalexcel for your own personal use subjected to restrictions set in these terms and conditions. You must not:

Republish material from Scalexcel Sell, rent, or sub-license material from Scalexcel reproduce, duplicate or copy material from Scalexcel Redistribute content from Scalexcel.

This Agreement shall begin on the date of payment. Our payment is done safely via Stripe (www.Stripe.com). We will take payment from your card at the time you place your order. Pricing unless otherwise stated all prices shown at Scalexcel are inclusive of VAT and other applicable taxes. 

Hyperlinking to our Content

The following organizations may link to our Website without prior written approval:

Government agencies; Search engines; News organizations; Online directory distributors may link to our website in the same manner as they hyperlink to the Websites of other listed businesses; and system-wide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our Web site.

No use of Scalexcel's logo or other artwork will be allowed for linking absent a trademark license agreement.

Without prior approval and written permission, you may not create frames around our Webpages that alter in any way the visual presentation or appearance of our Website.

Content Liability

We shall not be held responsible for any content that appears on your Website. You agree to protect and defend us against all claims that are rising on your Website. No link(s) should appear on any Website that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third-party rights.

Automatic Payment and Subscription Terms

As a SCALEXCEL user, you are responsible for paying the monthly subscription fee and any additional fees associated with your use of the service in accordance with these Terms. Payment is required when you set up your account and on a recurring basis thereafter, which is charged automatically to the payment method you provided. Your account will be charged every calendar month for the upcoming month's subscription, along with any additional fees and accumulated charges from the past period. Failure to use the service does not waive your payment obligations. You can pay using a credit or debit card, and payment details are collected securely by our financial data collection mechanism.

By providing your payment details, you authorize automatic payment collection for the specific service purchased. If we are unable to process your payment, we may charge a lesser amount to pause your account while we attempt to contact you for updated payment information.

Scalexcel reserves the right to modify the fees for its Services at any time. However, for Services that are billed on a subscription basis, any changes to the fees will only take effect at the end of your current billing cycle. Scalexcel will provide you with prior notice of any changes to the fees via SMS or Email.

To cancel your subscription, you can do so through your account dashboard, by emailing info@scalexcel.com, or texting us at our contact number at least ten days before the start of your next subscription month. SCALEXCEL may terminate your account and/or service for unpaid fees, and you will be responsible for all outstanding charges and expenses, including legal fees and expenses for any collection processes. Additionally, applicable taxes may be charged by SCALEXCEL.

When cancelling an annual subscription, you will receive a refund, prorated for the remainder of the annual term.

Refunds and Free Trial

Some subscribers of SCALEXCEL, may receive a 30-day Free Trial. If so, for the following two months, if you have not previously received a refund, you are guaranteed a refund for the next 60 days of your plan after the free trial if you choose. This refund is available for a limited period and must be requested no later than five days before the end of your first 3 months (90 days). Please note that this offer is only available to new subscribers and cannot be used by those who have already received a refund or are previous subscribers.

To request a refund for the first month of your subscription, please send an email to info@scalexcel.com or text "Refund" to our contact number at least five days before the start of your next subscription month. Once your refund has been confirmed via email and SMS, you can expect to see it reflected in your bank account within 5-7 business days.

Reservation of Rights

We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amen these terms and conditions and its linking policy at any time. By continuously linking to our Website, you agree to be bound to and follow these linking terms and conditions.

Removal of links from our website

If you find any link on our Website that is offensive for any reason, you are free to contact and inform us at any moment. We will consider requests to remove links but we are not obligated to or so or to respond to you directly. We do not ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we promise to ensure that the website remains available or that the material on the website is kept up to date.

We do not make any earnings, efforts, or return on investment claims. Our software, tools, or other offerings do not guarantee any specific amount of money or success. We do not offer a business opportunity, get rich quick program, guaranteed system, franchise system, or a business in a box. Therefore, please purchase our products or services with the understanding that using the information and software will require time and effort, and may be applicable in some situations, but not others. Finally, you agree to indemnify SCALEXCEL if your business violates any laws and a claim is made against SCALEXCEL.
